Terms of Sale: By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.
In order to contract Company you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Company retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be Company or may in some cases be a third party. Where a contract is made with a third party Company is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
(b) Pricing and Availability. Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.
(c) Payment. Upon receiving your order we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorization being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been dispatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.

A single, neutral arbitrator will resolve Claims. The arbitrator will be either a lawyer with at least ten (10) years’ experience or a retired or former judge, selected in accordance with the rules of the American Arbitration Association. The arbitration will follow the procedures and rules of the American Arbitration Association which are in effect on the date the arbitration is filed unless those procedures and rules are inconsistent with these Terms and Conditions, in which case these Terms and Conditions will prevail. Those procedures and rules may limit the discovery available to you or us. The arbitrator will take reasonable steps to protect your customer account information and other confidential information if requested to do so by you or us. Each party to the arbitration will bear the expense of that party's attorneys, experts, and witnesses, and other expenses, regardless of which party prevails, but a party may recover any or all expenses from another party if the arbitrator, applying applicable law, so determines. The arbitrator's award is final and binding on the parties unless we or you appeal it in writing to the arbitration firm within fifteen (15) days of notice of the award. The appeal must request a new arbitration before a panel of three neutral arbitrators designated by the American Arbitration Association. An award by a panel is final and binding on the parties after fifteen (15) days has passed. Any Claim you have must be commenced within one (1) year after the date the Claim arises. As noted above, you and Company hereby voluntarily and knowingly waive any right either may have to a jury trial.
We will not choose to arbitrate any Claim you bring in small claims court. However, if such a Claim is transferred, removed or appealed to a different court, we may then choose to arbitrate.
In the event this arbitration clause is not enforceable by the specified arbitration organization, the parties will mutually agree upon another arbitration organization that will enforce this clause.
Class Action Waiver: YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND COMPANY ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND. CLAIMS AND REMEDIES SOUGHT AS PART OF A CLASS ACTION, PRIVATE ATTORNEY GENERAL OR OTHER REPRESENTATIVE ACTION ARE SUBJECT TO ARBITRATION ONLY ON AN INDIVIDUAL (NON-CLASS, NON-REPRESENTATIVE) BASIS, AND THE ARBITRATOR MAY AWARD RELIEF ONLY ON AN INDIVIDUAL (NON-CLASS, NON-REPRESENTATIVE) BASIS.

Processing Time
We hate to make you wait, especially on new makeup! So at theBalm, we strive to process orders as soon as they’re received. Our standard processing time is between 2-7 business days; processing times may vary during sales, Holidays, or promotional events. No adjustments can be made on orders once they are placed. No pricing adjustments can be made on orders prior to sale or after sale.
Domestic USA Shipping
theBalm currently offers free standard shipping on all domestic U.S orders, in addition to Alaska and Hawaii (exceptions include Flash Sales and other site wide promotions. Please see our Flash Sale FAQ's page for details)! Our standard processing time is between 2-7 business days; processing times may vary during sales, Holidays, or promotional events, and may be further impacted by UPS, USPS or Fedex delivery times during COVID-19.
Puerto Rico Shipping
theBalm Standard Puerto Rico shipping is $30 or free for orders over $150. Puerto Rico shipping fees may vary during sales, Holidays, or promotional events.
International Shipping
theBalm Standard international shipping is $30 or free for orders over $150. Fees do not include duties or taxes. If you have questions regarding the duty or tax rate for your package, please contact your local postal service for more information.
International shipping fees may vary during sales, Holidays, or promotional events, duties and taxes are not included in advertised shipping rates on thebalm.com and are the responsibility of the receiving customer.

Please note the below policy does not apply for BOGO's, bundles, or any value sets.
If for any reason you are unhappy with your purchase from theBalm.com, we will gladly accept your return if received within 30 days from the shipment date.
Unused product can be returned for either store credit to www.theBalm.com or a refund of the purchase price (not including shipping). Products purchased in bundles cannot be returned or exchanged.
We’d be happy to exchange any gently used products for store credit to www.theBalm.com if received within 30 days from the shipment date, for domestic USA shipments only, in addition to Alaska and Hawaii. We are unable to honor exchanges on International and Puerto Rico shipments.
We are unable to accept returns and exchanges of excessively used products or products not purchased from theBalm.com.
Please mail your return or exchange to the address below and include a reference to your order number. Turnaround time for processing your return is generally 3 business days, but can fluctuate depending on the time of year. Once the return has been received and inspected in our warehouse you’ll receive an email notification confirming your return.
If your return qualifies for a refund, your refund will be applied to the original form of payment. Please allow up to five business days for the refund to be processed by your bank.
If an exchange was requested you will receive an email notification with either tracking information or your merchandise credit to be used at theBalm.com.

Returns for products purchased through our Shade Match Service
Domestic U.S Customers ONLY, in addition to Alaska and Hawaii
We understand how difficult it can be when ordering foundations and concealers online, so we offer a Shade Match Guarantee for your convenience. If you did not get the perfect match on your first order, you can exchange the product for a different shade within 30 days at no cost to you. Please contact us at info@thebalm.com to get shade-matched into your new shade. We will then help you exchange and receive your new shade. theBalm will cover all domestic continental US shipping costs on your replacement Anne T. Dotes product. Shade Match Guarantee applies to a replacement order on your first purchase only.
International Customers and Puerto Rico Customers
Our Shade Match Guarantee extends to our International Customers as well, however International Customers are responsible for shipping costs associated with the new product.
